The following Terms of Service, which include the Privacy Policy, Fee & Changes,Cancellations & Refunds, Membership Policy and any guideline, policy or content displayed on the Website, are a legally binding contractual agreement between you (“User, “you,” “your”) and Rifni (‘Rifni, ‘Rifni.com’,“we,” “us”) (hereinafter collectively referred to as the “Terms of Service“). By visiting or using the services available from the domain and sub-domains of Rifni.com (the “Website“), you agree to be legally bound by these Terms of Service. We reserve the right to revise these Terms of Service and all linked information from time to time in our sole discretion by updating this posting or any linked information. Unless otherwise provided in such revision, the revised terms will take effect when they are posted.

1. Overview and Definitions

Rifni operates an online marketplace facilitating interactions between buyers of professional services (“Employers”) and providers of professional services. Both Employers and Freelancers are collectively referred to as “Registered Users.” The Website offers various features allowing Registered Users to:

Employers can create profiles, post projects, search for Freelancers, communicate, negotiate, award projects, manage projects, provide feedback, and make payments.

We offer Registered Users a range of services defined and subject to these Terms of Service (referred to as the “Services”). We may modify, add, or remove some or all of these Services at our sole discretion, with reasonable notice posted in advance on the Website. Capitalized terms within these Terms of Service carry the following meanings:

  • Account: Refers to the account created by the Website upon registration.
  • Assumed Payment Liabilities: Denotes the portion of a Freelancer’s total service charges for a Project that Rifni agrees to assume in consideration of the Service Charges.
  • Dispute Resolution Service: Describes the service detailed in Section 7.
  • Employer’s Acceptance of Services: Involves:
    • With respect to an Invoice, a transfer of funds from the Employer to Rifni regarding such Invoice.
    • With respect to the Safe Deposit Service, the earlier occurrence of either:
      • Agreement between the Employer and the Freelancer on the rightful recipient of funds.
      • Completion of the Dispute Resolution Service process.
  • Rifni Billing and Payment Services: Encompasses the Rifni Invoice Service and the Safe Deposit Service.
  • Rifni Invoice Service: Describes the service outlined in Section 5(A).
  • Safe Deposit Service: Outlines the service detailed in Section 5(B).
  • Services: Collectively, they represent the Rifni Billing and Payment Service, the Dispute Resolution Service, and other services accessible on the site.
  • Website: Refers to the website operated by Rifni at Rifni.com or any replacement URL.

By using our platform, you acknowledge and accept these terms and conditions.

2. REGISTRATION

Eligibility To access our Services through our Website, you must be a legal entity or an individual who is eighteen (18) years of age or older and capable of forming legally binding contracts. By becoming a Registered User, you agree to accept all the terms and conditions contained within these Terms of Service, as well as those incorporated by reference or linked on our Website. As a Registered User, you commit to the following:

  1. Comply with the Terms of Service and adhere to the processes, procedures, and guidelines outlined on the Website.
  2. Assume financial responsibility for your utilization of the Website and any services purchased or delivered.
  3. Fulfill the obligations specified in any Project Agreement you accept, unless such obligations contravene the law or the Terms of Service. Rifni reserves the sole discretion to refuse, suspend, or terminate Services for any individual.

Registration To become a Registered User and access our Services, you are required to register for an Account. During registration, you agree to provide accurate, complete, and up-to-date information as prompted by the registration form and any other forms you access on the Website. It is your responsibility to maintain the accuracy and completeness of this information.

Accounts & Profiles General Upon registration as a Registered User, the Website will create an Account for you on Rifni.com and associate it with a unique account number.

Username & Password During registration, you will select a username and password for your Account. As a Registered User, you are solely responsible for maintaining the confidentiality of your chosen username and password. You hereby authorize Rifni to assume that any person accessing the Website using your username and password is you or acting on your behalf. If you suspect any unauthorized use of your Account, you agree to promptly notify us.

3. RELATIONSHIPS

Employer and Rifni

Project Agreement The engagement, contracting, and management of a project are between an Employer and Rifni. Upon acceptance of a quote, the Employer agrees to purchase, and Rifni agrees to facilitate, the services and related deliverables in accordance with the following agreements: (a) the agreement between the Employer and Rifni, including the Project Proposal, Project Description, and other terms and conditions as communicated on the Website or otherwise, (b) these Terms of Service, and (c) any other content uploaded to the Website by either party (collectively, the “Project Agreement”). You agree not to enter into any contractual provisions in conflict with these Terms of Service. Any provision of a Project Agreement in conflict with these Terms of Service is void. The Employer is responsible for managing, inspecting, accepting, and paying for satisfactory services and deliverables in accordance with the Project Agreement in a timely manner. Rifni is responsible for facilitating the performance and quality of the services in accordance with the Project Agreement in a timely manner. The Employer and Rifni each covenant and agree to act with good faith and fair dealing in performance of the Project Agreement.

Independence The Employer and Rifni each acknowledge and agree that their relationship is that of independent parties. Rifni shall facilitate services as an independent entity, and nothing in these Terms of Service shall be deemed to create a partnership, joint venture, agency, or employer-employee relationship between Rifni and the Employer. You acknowledge, agree, and understand that Rifni does not, in any way, supervise, direct, control, or evaluate any third-party service providers or their work, and is not responsible for any Project, Project terms, or Work Product.

Work Product Rifni is expected to facilitate the Work Product (deliverable or outcome) of the Project Agreement to the Employer unless a Non-Disclosure Agreement (NDA) is signed between Rifni and the Employer. Rifni may request proof of work performed at any point for verification as per the Project Agreement.

Registered Users & Rifni

While we facilitate the process, it’s important to note that Rifni acts as a supportive partner rather than a party to the direct transaction between you and our professionals. We believe in your ability to choose the right professionals for your projects.

We are committed to upholding the highest standards of quality, safety, and legality in the services we facilitate. You can trust that our dedicated professionals are here to deliver exceptional results. Rifni stands behind the quality and safety of the services provided through our platform.

Third-Party Beneficiary of Project Agreement The Employer acknowledges that the value, reputation, and goodwill of the Website depend on their performance of their covenants and agreements as set forth in their Project Agreement. The Employer therefore appoints Rifni as a third-party beneficiary of their Project Agreement for the purpose of enforcing the obligations owed to, and the benefits conferred on, Rifni by these Terms of Service. The Employer further agrees that Rifni has the right to take such actions with respect to the Project Agreement or their Accounts, including suspension, termination, or any other legal actions, as Rifni, in its sole discretion, deems necessary to protect the value, reputation, and goodwill of the Website.

Agency These Terms of Service and any registration for or subsequent use of this Website by any user or Registered User will not be construed as creating or implying any relationship of agency, franchise, partnership, or joint venture between you and Rifni, except and solely to the extent expressly stated.

Taxes Registered Users are responsible for payment and reporting of any taxes. Rifni is not obligated to determine the applicability of any taxes or to remit, collect, or report any such applicable taxes. You agree that you will abide by any and all applicable state and government tax statutes, regulations, and common law. In the event Rifni receives a notice of non-compliance with any such statute, regulation, or common law, Rifni will deem such receipt a breach of this section and will suspend your Account.

4. RIFNI FEES
  1. Rifni does not charge any Platfrom fee or Service fee from the buyer to Purchase any Freelance Service on Rifni. Buyer can Purchase any Freelance Services without Any Extra cost other than Job price.
  2. We reserve the right to change service fees, processing fees or any other fee that may be charged by Rifni at any time, at the sole discretion of Rifni and upon reasonable notice posted in advance on the Website.
5. RIFNI BILLING & PAYMENT SERVICES
  1. When a Freelancer completes a project for an Employer, the Freelancer will prepare an electronic invoice (the “Invoice”) and submit it to Rifni through the Website. The Freelancer must submit an Invoice for each project. The Invoice will include details such as hours worked, payment amount, and project description (“Invoice Details”). Invoice Details will be considered final unless the Freelancer requests a review or waives this right. Rifni encourages all Freelancers to review Invoice Details. Rifni will forward the Invoice to the Employer, who will then submit the specified payment (“Payment”) to Rifni. When an Employer makes a payment through the Rifni Invoice Service, Rifni deducts the applicable Service Charges as described on the Website and remits the remaining Payment to the Freelancer.Invoice Disputes If an Employer reasonably disputes any Invoice, the Employer will pay all undisputed amounts within the specified time frames, and the parties will work together to resolve the disputed amounts. Payment of disputed amounts will be withheld until the dispute is resolved. Rifni’s obligation to pay any Payment (less applicable Service Charges) is contingent upon the following:
    • Rifni’s receipt of Payment from the Employer.
    • Resolution of all outstanding disputes related to the Invoice and/or Payment.

    Safe Deposit Service The Safe Deposit Service allows Employers to transfer certain payment responsibilities to Rifni.

    General At an Employer’s request, after the Employer has made payment to Rifni for services to be provided by a Freelancer, Rifni assumes responsibility for disbursing payment for the Freelancer’s services (less applicable Service Charges). These funds immediately become Rifni’s property upon receipt. However, Rifni commits to refund these funds to the Employer if either of the following conditions is met:

    • The Freelancer acknowledges that services were not completed.
    • The Employer and Freelancer conclude the Dispute Resolution Service process, determining that the Employer is entitled to the funds. Rifni keeps both parties informed of the Assumed Payment Liability’s status. If a party requests Dispute Resolution Service regarding this status, Rifni will notify both parties that the matter will be addressed through the Dispute Resolution Service.

    Safe Deposit Disputes If either the Employer or Freelancer reasonably disputes the quality or completion of services provided by the Freelancer, Rifni will not have payment obligations related to relevant fees until the dispute is resolved in accordance with Section 6 below. Rifni’s obligation to pay any Payment (less applicable Service Charges) is expressly conditioned upon the resolution of all outstanding disputes related to that Payment.

    Funds Transfer

  1. General To receive funds due to you, you must request such funds and indicate your selection of the funds transfer methods available on the Website. Any such requests shall be subject to the conditions and restrictions contained on the Website and in these Terms of Service. Not withs tanding any other provision of these Terms of Service, if Rifni determines in its sole discretion that a Registered User has violated the conditions and restrictions of the Website or Terms of Service, Rifni has the right to refuse to process such request.
  2. Hold On Transfers Rifni reserves the right, at its sole discretion, to place a hold on requested transfers if Rifni suspects monies may be subject to charge back, bank reversal, failure to clear or fraud. Rifni will release a hold as soon as practical.

6.Legal Relationship

Rifni does not act as your agent concerning any funds transferred to Rifni for Assumed Payment Liabilities. Freelancers are responsible for properly crediting Employers for payments made by Rifni for services provided.

Payment Provider Rifni operates as a payment provider, offering the Rifni Billing and Payment Services over the Internet. We do not control the services invoiced or paid for through our services, nor can we guarantee the completion of transactions by Employers or Freelancers. We are not responsible for the accuracy, timeliness, or quality of work produced by Freelancers as a result of awarded Projects.

Important Acknowledgment When using the Rifni Billing and Payment Services, you acknowledge that:

    1. Rifni serves as an administrative platform and not as a trustee or fiduciary for Employers or Freelancers.
    2. Rifni is not a financial institution; our services are payment services, not banking services.
    3. Rifni is not a bank, and any payments transferred through Rifni are not insured deposits; they are subject to default, loss, or forfeiture.

Rifni, as a merchant, shall not be held liable for any loss or damage resulting directly or indirectly from the decline of authorization for any Transaction due to the Cardholder exceeding the mutually agreed preset limit between us and our acquiring bank.

Authorized Payments Are Final Your use of the Rifni Billing and Payment Services constitutes your agreement to pay for any authorized amounts retained from transactions and, as applicable, charged to your credit card, bank account, or PayPal account. Once authorized, these payments are final. Upon Employer’s Acceptance of Services,

  • Rifni assumes no further liability for Payment of said services.
  • Employers acknowledge that Rifni has fulfilled its service in respect to the Payment for the Assumed Payment Liability or Invoice, as applicable.
  • Employers release Rifni from all liability related to such Payment.

Fraudulent Transactions, Errors, and Chargebacks Rifni reserves the right to seek reimbursement from you in the event of a fraudulent transaction, erroneous or duplicate transaction, or a chargeback or reversal from an Employer’s credit card company, bank, or PayPal. You agree to cooperate in fraud investigations and allow Rifni to investigate any suspicious transactions. Rifni may seek reimbursement through various means, including charging your Account, deducting from future transfers, charging your credit card, or using a third-party collection agency. Failure to pay for reimbursements may result in Account termination.

Currency Fluctuations The Rifni Billing and Payment Services operate in INR. Rifni is not responsible for currency fluctuations occurring when billing or crediting a card in a currency other than INR, nor for fluctuations when receiving or sending payments via check, NEFT Transfer, credit card account, or PayPal account.

Exclusivity and Non-Circumvention Employers and Freelancers agree to use the Rifni Billing and Payment Services for all payments, whether first-time, repeat, or follow-on. They further agree not to circumvent these services or associated fees. Employers and Freelancers must notify Rifni if the other party attempts to make payments outside the Website. Reporting circumvention or breaches is encouraged and should be sent to [email protected].

Agreement to Pay In case Rifni does not receive payment for authorized amounts through the Rifni Billing and Payment Services, you agree to pay immediately upon Rifni’s demand. You also agree to cover interest charges, attorneys’ fees, and collection costs incurred by Rifni. Rifni may stop processing further payments and apply held amounts towards deficiencies or costs resulting from your use of the Rifni Billing and Payment Services. Rifni may also report such matters to relevant authorities.

Guaranteed Contest Prize Money deposited for Guaranteed Contests is non-refundable. Contest Cancellation requests within 24 hours may lead to the cancellation of the Guaranteed Contest and a refund of the Prize Money.

7. DISPUTE SERVICES
  1. Eligibility Rifni offers the Dispute Resolution Service to those Registered Users who have requested Rifni to handle payment liabilities for services and are engaged in a dispute related to a project that is (i) in accordance with a project initiated by a client through the Website, (ii) based on a proposal submitted by your agency through the Website for such a project, and (iii) accepted through the Website by the client. Clients and your agency agree that any disputes regarding the underlying fees for Assumed Payment Liabilities shall be governed by the terms of this Section 7.Process Mediation In any dispute between Registered Users relating to a project eligible for Dispute Resolution Service, you agree to engage in good faith mediation through Rifni for a period of ten (10) business days. This ten-business day period begins the day either party requests Dispute Resolution Service through the Website. If the mediation results are acceptable to both parties, you agree to indicate your approval through the Website, and Rifni will disburse funds according to the mediation results. If you are dissatisfied with the progress, or if ten (10) business days have passed since notifying Rifni of a dispute between your agency and a client, you agree to submit the dispute to binding arbitration, as further detailed below.

    Arbitration In any dispute between your agency and a client that cannot be resolved through mediation, you expressly agree and acknowledge that Rifni or a third party chosen by Rifni will arbitrate the dispute in accordance with these Terms of Service and the Website.

    You acknowledge and agree that Rifni will interpret any Project Agreement based on the transaction’s course of dealing and common industry practices. Specifically, in rendering its decision, the arbitrator shall only consider: (i) the Project Agreement, (ii) the parties’ course of dealings evidenced by activity on or communications through the Website, (iii) the Project itself, and (iv) any information or communication agreed upon by the client and your agency.

    Rifni will render its decision within five (5) business days of a failed mediation. During this time, you are encouraged to negotiate an amicable settlement with the client you are in dispute with.

    You agree that Rifni’s decision, as arbitrator, shall be final, binding, and not subject to appeal. Consequently, within a reasonable time after rendering a decision, Rifni will transfer funds as per the arbitrator’s decision.

    If you are the prevailing party in the arbitration decision, you agree that you shall have no right, title to, interest in, or license to the project in dispute. In such a case, you agree to return any physical copies of the project in your possession and destroy any electronic copies.

    Communication You agree and acknowledge that Rifni will use the email address corresponding with your Account registered at the time a dispute arises to notify and communicate with you regarding any dispute. You are solely responsible for receiving any notification or communication sent by Rifni using the email address corresponding with your Account registered at the time a dispute arises.

8. TERM- TERMINATION & SUSPENSION
  1. Effective Upon Use
    • These Terms of Service become effective as a contractual agreement when you use the Website.
    • The agreement remains in effect until your Account is terminated, as detailed below.

    Termination Rights

    • Either party can terminate this agreement by providing written notice unless otherwise agreed upon.
    • Upon termination:
      1. Your Account is automatically closed.
      2. Rifni will continue necessary services to complete ongoing transactions.
      3. You must settle any outstanding amounts with Rifni and Freelancers.

    Grounds for Account Action

    Rifni’s Rights

    • Rifni may issue warnings or take action on your Account if:
      1. You breach any terms and conditions outlined in these Terms of Service.
      2. We cannot verify the information you provide.
      3. We believe your actions could lead to legal liability or go against the Website’s interests.
      4. We uncover fraudulent activities by you.

    Account Suspension and Termination

    Consequences of Account Actions

    • In cases of indefinite suspension or termination:
      1. You must cease using the Website under any Account.
      2. Registering under a new Account is not allowed.

    Data and Material

    • Upon Account termination:
      • You may lose access to stored data, messages, files, and other materials.
      • This includes the deletion of your previous posts and proposals.

    Fraudulent Activities

    Rifni’s Right to Terminate

    • Rifni reserves the right to terminate your Account if fraudulent activities are detected.
9. PRIVACY AND CONFIDENTIALITY

Your use of the Website and the services provided therein and thereby is governed by the terms of these Terms of Service and the Rifni Privacy Policy. It is your responsibility to review the Rifni Privacy Policy, which is incorporated by reference, and we suggest that you review the Privacy Policy and print a copy for yourself. The Privacy Policy is posted on the Website and may be updated from time to time. Unfortunately, we cannot ensure that disclosure of your personal information will not occur in ways not described in the Privacy Policy. We may be required by law to disclose information to government authorities, law enforcement agencies or third parties upon subpoena, and you authorize us to disclose information as we believe, in our sole discretion, is necessary or appropriate.

  1. Registered User Content
  2. You are solely responsible for information posted on our Website, including but not limited to (a) any audio, video or photographic content (collectively, “Multimedia Content“), (b) any posting or listing made in any public message area, through any email feature or through Rifni feedback feature (collectively, “Non-Multimedia Content“) and (c) any other content of a personal nature including but not limited to your resume, biography, work history and work product produced for another Registered User including Companies (“Personal Content“). You retain ownership of all Multimedia Content and Personal Content, subject to the licenses granted herein.
  3. You hereby assign to Rifni your rights in any Non-Multimedia Content. You grant us a non-exclusive, worldwide, perpetual, royalty free, irrevocable right to exercise all copyright and publicity rights with respect to the Multimedia Content and to use such Multimedia Content for the purpose of advertising and publicizing Rifni products and services and you grant us a non-exclusive, worldwide, perpetual, royalty free, irrevocable right to use the Personal Content for the purpose of providing Services.
  4. Your information must not: (a) infringe any third party’s rights, including but not limited to intellectual property, publicity or privacy; (b) be defamatory, trade libelous, threatening or harassing; nor (c) be obscene, indecent or contain pornography.
  5. We do not endorse any information posted by Registered Users and we are not liable for any such information posted on the Website, including but not limited to any information posted about you. We reserve the right to take any action, in our sole discretion, with respect to information posted on the Website which we believe is inappropriate, including but not limited to termination of your Account. However, we cannot, nor do we, control the information provided by you or other Registered Users or other content providers which is made available through our system.
10. REPRESENTATIONS, DISCLAIMERS, LIMITATIONS AND EXCLUSIONS
  1. Registered User Representations and Warranties. All Registered Users represent, warrant, and agree:
  2. grant access to an Account only to users authorized to act on behalf of the Registered User and only in accordance with these Terms of Service.
  3. to be fully responsible and liable for any action of any user who uses your Account.
  4. not to use your Account, username, or password of another Registered User that you are not expressly authorized to use.
  5. not to allow any third party who is not authorized to do so to use your Account at any time.
  6. not to use any device, software or routine, including but not limited to any viruses, Trojan horses, worms, time bombs, robots or denial-of-service attacks, intended to damage or interfere with the operation of the Website or any transaction being conducted through the Website.
  7. not to intercept or expropriate any system, data or personal information from the Website.
  8. not to take any action that imposes an unreasonable or disproportionately large load on the Website infrastructure, including but not limited to “spam” or other such unsolicited mass emailing techniques.
  9. that it has the right and authority to enter into the Terms of Service and to transact business hereunder.
  10. that they are using the Website solely for the purpose of entering into a bona fide business transaction with other Registered Users.
  11. that they will not use the Website or its services to defraud or mislead any person or entity, including without limitation Rifni or any Register User.
  12. Warranty Disclaimer THE SERVICES PROVIDED BY Rifni OR OUR THIRD-PARTY SERVICE PROVIDERS ARE PROVIDED “AS IS,” AS AVAILABLE, AND WITHOUT ANY WARRANTIES OR CONDITIONS (EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OR TRADE). WE MAKE NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE QUALITY, IDENTITY OR RELIABILITY OF ANY THIRD PARTY, OR AS TO THE ACCURACY OF THE POSTINGS MADE ON THE WEBSITE BY ANY THIRD PARTY. SOME STATES AND JURISDICTIONS DO NOT ALLOW FOR ALL THE FOREGOING LIMITATIONS ON IMPLIED WARRANTIES, SO TO THAT EXTENT, IF ANY, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
  13. Limitation of LiabilityIN NO EVENT SHALL WE OR OUR THIRD-PARTY SERVICE PROVIDERS BE LIABLE TO YOU OR ANY OTHER REGISTERED USER FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES PURSUANT TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  14. General ReleaseIf you have a dispute with another Registered User, you release Rifni (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.
  15. IndemnityYou agree to defend, hold harmless and indemnify Rifni from and against any and all losses, costs, expenses, damages or other liabilities incurred by Rifni from and against any cost, liability, loss, damage, cause of action, claim, suit, proceeding, demand or action brought by a third party against Rifni: (1) in connection with your use of the Services including any payment obligations incurred through use of the Rifni Billing and Payment Services; or (2) resulting from: (a) your use of the Website (b) your decision to supply credit information via the Website, including personal financial information; (c) your decision to submit postings and accept offers from other Registered Users; (d) any breach of contract or other claims made by Registered Users with which you conducted business through the Website; (e) your breach of any provision of these Terms of Service; (f) any liability arising from the tax treatment of payments or any portion thereof; (g) any negligent or intentional wrongdoing by any Registered User; (h) any act or omission of yours with respect to the payment of fees to any Freelancer; (i) your dispute of or failure to pay any Invoice or any other Payment; or (j) your obligations to a Freelancer. Any such indemnification shall be conditioned on our: (i) notifying you in writing of any such claim, demand, action, cost, liability, loss or threat of any thereof; (ii) cooperating with you in the defense or settlement thereof; and (iii) allowing you to control such defense or settlement. We shall be entitled to participate in such defense through our own counsel at our own cost and expense. We reserve the right to report any wrongdoing of which we become aware to the applicable government agencies or otherwise.
  16. LinksThe Website may contain links to third-party web sites not under the control or operation of Rifni. When we provide links, we do so only as a convenience and do not endorse and are not responsible for the content of any linked site or any link contained in a linked site.
  17. DataYou are responsible for creation, storage, and backup of your business records. These Terms of Service and any registration for or subsequent use of this Website will not be construed as creating any responsibility on Rifni’s part to store, backup, retain, or grant access to any information or data for any period.
11. CONTESTS TERMS AND CONDITIONS
  1. Buyers can promote a Contest hosted on the Website by providing a Contest Brief and paying the Contest Prize in accordance to our instructions provided on the Website. A Buyer which promotes a Contest acknowledges and agrees that it is solely responsible for the operation and promotion of the Contest and warrants that it will comply with all applicable laws in respect of the operation and promotion of the Contest. We have no liability for loss suffered by a User in connection with a Contest including but not limited to loss suffered (or penalties imposed) in connection with a contravention of law.
  2. Entrants may submit their entries in image formats as specified on the Website. All entries must comply with the Contest Brief and must not infringe any Intellectual Property Rights. Any entry which infringes any Intellectual Property Rights will be an ineligible entry and subject to removal either by the Buyer or us and subject to action as per our Copyright Infringement Policy.
  3. Buyers can promote either: (1) a regular prepaid Contest, under which a Buyer may select one or more winning Entrant(s) or Buyers may request that the Contest Prize be refunded to them if a winner has not been chosen within 30 days of the contest closing date; or (2) a guaranteed Contest, under which a Buyer may select one or more winning Seller(s) and if no winner is selected, we will release the Contest Prize to Entrants of the guaranteed Contest and charge the appropriate fees and the Buyer will have no rights to have the Contest Prize released to them or to use any entries that have been submitted. After 30 days of the contest closing date, we reserve the right to distribute the contest prize to the participating freelancers. However, In rare cases, We have a right to refund the money associated with a Guaranteed Contest if we find that the Contest didn’t get any appropriate entries.
  4. After awarding a Contest Prize, the Buyer and winning Entrant(s) will enter into a Contest Handover and when the winning Entrant(s) has uploaded the winning entry (including all related files) to the Buyer, the Contest Prize will be released to the winner of the Contest unless disputed by the Buyer in which case the dispute must be resolved between the Buyer and winning Entrant(s) before we can release the Contest Prize to the winning Entrant(s).
  5. Close relatives, friends and family members of the Contest host are not allowed to participate in the Contest.
  6. Charges paid for add ons like “FEATURED”, “TOP CONTEST”, “URGENT”, “SEALED” etc are NON REFUNDABLE charges and they will not be refunded to the user under any circumstances.
  7. For avoidance of doubt, the Buyer has no right or license to use any entries other than the winning entry/entries. The Buyer may not: (1) promote a Contest via the Website if the Buyer is hosting a similar contest through another service; (2) allow or request Sellers to submit entries to the Buyer via other means than the Website; and (3) award another Account that might be deemed as collusion or awarding another Account owned by the Buyer.
12. RESTRICTIONS

With a few exceptions, most everyone over the age of 18 who has an Internet connection can apply to join. Although not all applications are approved, we’re proud to support a thriving network of global freelancers.

Regardless of where you are living, you are responsible to comply with any work authorization requirements you may have. Unfortunately, we are not able to advise you on whether you can use Rifni except in the specific restriction cases below.

Federal Law restricts Rifni (MyRemoteTeam, Inc) from conducting business with individuals and entities based in certain countries. Businesses or individuals in the following countries are not permitted to register for accounts or utilize our platform:

  • Iran
  • North Korea
  • Syria
  • Cuba
  • Sudan

And any other country restricted by law (this changes occasionally)
